Terms & Conditions

Definitions:

In this agreement the terms used hereunder shall have the following meaning:

Hire Form The form completed by the hirer for the hire of a Motorcaravan

Company Fleetgrace Limted T/A Emm-Bee Caravans, Prettywood, Bury. BL9 7HX

Hirer The person named on the hire form Driver The Hirer or any other person named on the hire form.

Vehicle The vehicle as described on the hire form

Hire period The period from the date and time as set out on the hire form until the date of delivery of the vehicle into the physical custody of the Company.

Hire Charge The hire charge for the hire period calculated in accordance with the Company's current tariff at the time in force.

The Insurance The Company Policy of insurance on the vehicle which is available for inspection at the Company's office.

Travel Insurance Additional assistance, recovery and personal Insurance compulsory when travelling overseas.

Accessories Cooker, Oven, Fridge, Heater, Water Heater, Skylights, Toilet, Shower & Taps, Kitchen & Taps, Tyres and any motorhomes fittings and furnishings.

Fit for the purpose:

a) The Hirer acknowledges that the Motorcaravan is fit for his purpose as a Motorcaravan and is in good condition and further the Hirer undertakes to return the Motorcaravan and its accessories, in the same condition, fair wear and tear accepted to the place and on the date due back specified on the hire form.

b) The Hirer is also responsible for daily safety checks ie, oil, water, tyres etc. whilst the Motorcaravan is on hire. Any damage caused to the Motorcaravan by failure of the Hirer to carry out these checks will be charged to the Hirer and cannot be waived.

Collection & return

a) Hirers must confirm an appropriate collection time for the Motorcaravan at least 24 hours prior to commencement of the hire period which will be within the following times: Collected on the day of commencement of the hire period from 3.30pm onwards and returned by 10.00am on the day of termination of the hire period unless otherwise agreed with the Company on 24 hours notice.

b) If the Motorcaravan is not returned by the Hirer to the Company on the last day of the hire period, at the appropriate time the Hirer shall be responsible for a surcharge of one full days hire per day or part day.

c) The Company reserves the right to deduct any surcharge from the insurance deposit which is held by the Company (see Insurance 'c')

Drivers:

The driver acknowledges that:

i) He / She is between the ages of 22 and 70 years of age (if over 70 approval of the Company to be obtained prior to commencement of the hire period)

ii) He / She has held a full driving license for at least one year, that he has not had his driving license endorsed or penalty points imposed during the five years immediately prior to the period of hire and that there is no prosecution outstanding for any offence. Parking and not more than two speeding offences in the past five years may be ignored:

iii) If He / She does have any endorsements these have to be disclosed on the hire form:

iv) He / She has no physical defect, infirmity, does not suffer from fits, diabetes or any heart complaint:

v) Whilst driving He / She has not been involved in any accident during the three years immediately prior to the period of hire (other than those disclosed on the hire form):

Payment

a) The Hirer shall pay a booking deposit of £200 at the time of reserving the vehicle for the hire period. This deposit should be deducted from the hire charge. This deposit is non-refundable in the event of a cancellation by the Hirer.

b) The Hirer shall pay all monies due to the Company for the hire period 28 days prior to the commencement of the hire period, unless otherwise agreed by the Company. In the event of subsequent cancellation payment other than the insurance deposit (see Insurance 'c' below) are non refundable

Insurance

a) The cost of the insurance policy is included in the hire charge. An additional flat rate fee of £50 is payable for travel outside the UK.

b) In the event of any claim whatsoever or howsoever arising out of the hire of the vehicle, the Hirer shall be liable for up to £500 for any claim (the insurance excess on the insurance policy):

c) Prior to the collection of the vehicle, the Hirer shall pay either the sum of £250 as a deposit against the insurance excess, together with a further charge in respect of collision damage waiver ("CDW") which shall be calculated at the rate of £3.50 per day or otherwise a payment of £500 with no CDW cover (both sums to be referred to as "The insurance deposit"):

d) The policy if insurance in respect to the vehicle shall only remain in force for the hire period. In the event of the failiure of the Hirer to return the vehicle within the hire period, the Hirer shall be soley responsible for any damages including accidental damage, personal injury or consequntial loss which may arise and is put on notice that a criminal prosecution may be brought if the vehicle is driven without insurance cover.

e) The Hirer and driver shall at all times ensure compliance with the terms and conditions and limitations of the insurance policy which shall be deemed to be included in this agreement as if it were set out in full herein.

f) In the event the Hirer is to return the vehicle after the expiry of the hire period, he should notify the Company imediatley and insurance cover will be extended for the additional period. The Hirer will be charged in that respect at the rate of one full day's hire, in accordance with clause Fit for the purpose 'b' above.

g) Upon the return of the vehicle at the expiry of the hire period, the insurance deposit held by the Company will be refunded seven days thereafter for the purpose of the Company inspecting the vehicle to ensure it has been returned in a clean and undamaged state. The Company may deduct from the insurance deposit, such reasonable sums as are required to make good any loss or damage which may arise from the Hirers breach of responsibility as set out in clause 8 below:

h) In the event of any accident whatsoever or howsoever arising during the period of hire, the Company shall retain the insurance deposit unless the excess under the insurance policy is recovered from a third party at which time the insurance deposit shall be repaid to the Hirer: Travel insurance must be taken by the Hirer if the vehicle is to be taken overseas otherwise it is available if the Hirer wishes to cover cancellation costs, personal luggage and money, personal accident, medical and other expenses.

Breakdown and Repair

a) The vehicle is provided to the Hirer together with appropriate vehicle assistance and recovery insurance for use of the vehicle within the UK.

b) In the event of any breakdown or accident, the Hirer or driver shall seek the assistance of the vehicle recovery firm details of which shall be provided to the Hirer;

c) The Hirer or driver is authorised to allow repairs to the vehicle or it's accessories at a cost not exceeding £50, such monies to be reimbursed to the Hirer by the Company upon the production of receipted invoices:

d) The Hirer must seek the Company's authorisation before any repair is undertaken in excess of £50. In the event any repair is undertaken in excess of this amount (without prior authority), the Hirer shall be personally responsible foa) the full amount of the repair:

e) In the event of any breakdown outside of the Hirers control and or responsibility as set out in clause 8 below the Company will refund to the Hirer the hire charges for any complete days loss of use of the vehicle up to a maximum of 4 days;

f) If the vehicle cannot be repaired, the Hirer must arrange for the vehicle to be returned to the company's premises. In the event the vehicle is relayed to the Hirers home address, any additional charge for the relay of the vehicle back to the companies premises will be met by the hirer;

g) In the event of any accident the Hirer must complete an accident report form (as provide by the Company), which must be handed to the Company at the expiry of the hire period (or earlier). If the Hirer for any reason fails to complete an accident report form, the Company is at liberty to retain the insurance deposit, until such form has been provided or the companies insurance excess is recovered, which ever is later.

Responsibilities of the Hirer

a) The Hirer is responsible for;

i) Tyres or punctures (Hirers should satisfy themselves as to the condition of tyres at the time of collection);

ii) Keeping the vehicle is a clean and good state of repair;

iii) Breakage or damage to the accessories;

iv) Breakage or damage to any glass; i) Damage or theft of audio equipment; ii) Any costs or expenses subsequent to a breakdown other than those as referred to in clause 7 above;

General

a) If due to circumstances beyond the company's control, the vehicle reserved by the Hirer is unavailable, the Company reserves the right to provide a suitable alternative vehicle for the hire period. In the event such an alternative vehicle is not acceptable to the Hirer, or otherwise an alternative vehicle cannot be provided by the Company the liability of the Company shall be limited to the refund of any monies paid.

b) All conditions and warranties, express or implied as to quality, description and fitness for purpose of the vehicle or otherwise, are hereby expressly excluded and the Company shall not be liable to the Hirer or any third party for any loss howsoever caused;

c) Any addition to or alteration of the terms & conditions of this agreement shall be null and void, unless agreed upon in writing by both parties.

d) If any of the provisions are held invalid or are otherwise unenforceable, the reminder of the agreement shall not be invalidated unless in the reasonable opinion of the Company, the purpose of this agreement is frustrated. These terms and conditions are part of the hire agreement and are displayed in the Company's reception and also appear on the reverse of the hire invoice.
